السؤال :
السلام عليكم ورحمة الله جزاكم الله خيرا ما هو حكم 1- اخذ ذهب وفضه من تاجر الجملة على التصريف ليباع في محل بيع التجزئة بالتفويض مقابل عمولة ؟ 2- هل يجوز ان يكون مفوض البائع والمشتري شخص واحد بحيث يحدد البائع سعره والمشتري سعره ؟ 3- هل ياخذ الذهب والفضة المشغول والمضاف اليه احجار نفس حكم الذهب الصافي كالدينار والدرهم ام ان هناك احكام تترتب على هذه الإضافات ؟ 4- هل يغني الشيك المصدق عن العملة الورقية في عملية التقابض في بيع الذهب والفضة ؟ وما هو الحل او البديل للتقابض في حال كان المشتري في دولة مثل السعودية والبائع في دولة بعيدة مثل سويسرا ؟ هل يغني في هذه الحالة التحول البنكي للمشتري وتسليم الذهب للشحن للبائع ؟ 5- في بيع وشراء الذهب والفضة هل يمكن تثبيت السعر بين البائع والمشتري مع وجود عربون او مبلغ ضمان قبل وقت من عملية الحظور للتقابض ؟
