التمويل المالي والتمويل التجاري: لنطلق على الحالات التي تتضاءل فيها سلطة رب المال بحيث يترك القرار الإداري للطرف الآخر اسم التمويل المالي، وعلى الحالات التي تتوسع فيها سلطته بحيث يتمتع بكل صفات التاجر المعروفة اسم التمويل التجاري
- ففي التمويل المالي يتخذ قرار رب المال واحدًا من شكلين:
أ- اختيار الطرف المدير الذي يقدم إدارته وخبرته ويقوم باتخاذ القرارات الاستثمارية والتجارية، وتحديد الشروط العامة للعلاقة معه ومنها نوع النشاط الاستثماري ومجاله.
ب- اختيار الأصل الثابت الذي يتم استثماره بالإضافة إلى اختيار الطرف المدير.
- أما في التمويل التجاري: فإن رب المال يتخذ القرار الاستثماري كاملاً، أي أنه يقوم بما يعمله التجار في العادة، فيحدد السلعة التي يتملكها ويقوم بعملية تملكها وصيانتها وتخزينها وتسويقها ثم بيعها أو إيجارها للطرف الآخر. وقد يفعل ذلك في كثير من الأحيان بناء على أمر بالشراء من قبل الطرف المستفيد من التمويل.
٢- التمويل المباح أو الإسلامي هو تقديم ثروة عينية أو نقدية بقصد الاسترباح من مالكها إلى شخص آخر يديرها ويتصرف فيها لقاء عائد تبيحه الأحكام الشرعية.
ويلاحظ أن صيغ التمويل المباح تختلف عن بعضها اختلافات تتعلق بدرجة السلطة التي يتمتع بها الطرف المتصرف بالمال والحقوق والالتزامات المترتبة عليه.
وبشكل أدق فإن بعض صيغ التمويل المباح تتضمن إلقاء عبء اتخاذ القرار الاستثماري على الطرف العامل وحده وحصر دور المالك بأن يضع ما يملكه من نقود في المضاربة أو أرض المزارعة أو أشجار في المساقاة تحت تصرف الطرف الآخر دون أن يكون له الحق بالتدخل في قرارات الإدارة والاستثمار.
في حين أن بعض الصيغ الأخرى كالإجارة والبيع بالتقسيط مثلاً يقوم فيها المالك بتحديد نوع السلعة وامتلاكها وتحضيرها طبقًا للمواصفات المطلوبة من قبل الطرف الآخر ويتحمل ما ينشأ عن ذلك من التزامات ومسؤوليات مرتبطة بتملكه لها، غير أنه يستفيد من توفر الأموال لديه لتقديم شروط مالية ميسرة للطرف الآخر لقاء ثمن يدخل فيه اعتبار الاسترباح بالمال.
