تنظيم الأسرة
مقاصد الأسرة في الإسلام:
الإعفاف والسكن النفسي وشيوع المودة والرحمة والنسل (أي وجود الأولاد لاستمرار النوع البشري).
مجالات تنظيم الأسرة:
تظهر مجالات تنظيم الأسرة في عدة أمور:
أ- تنظيم الأسرة فيما يتعلق بالذرية، قلة أو كثرة.
ب- تنظيم الأسرة فيما يتعلق بالتمهيد لبنائها تمهيداً سليماً.
ت- تنظيم الأسرة اقتصادياً.
ث- تنظيم الأسرة في تحديد العلاقات بين أفرادها.
ج- تنظيم الأسرة علمياً وثقافياً واجتماعياً.
زيادة النسل:
زيادة النسل مقصد للإسلام من حضه على الزواج وهذه بعض الأدلة من القرآن:
ا- قوله تعالى { نسائكم حرث لكم فأتوا حرثكم أنى شئتم} [البقرة 223].
2- قوله تعالى{ المال والبنون زينة الحياة الدنيا} [سورة الكهف 46].
3- علمنا ربنا دعاء الصاحين فقال عز وجل { ربنا هب لنا من أزواجنا وذرياتنا قرة أعين وأجعلنا للمتقين إماما] [الفرقان 74]. إلى آيات كثيرة.
من السنة:
ا- قوله صلى الله عليه وسلم: "تناكحوا تناسلوا فإني مباه بكم الأمم"، رواه البيهقي.
2- قوله صلي الله عليه وسلم: "تزوجوا الودود الولود فإني مكاثر بكم الأمم يوم القيامة".
3- قوله صلى الله عليه وسلم: "ريح الولد من رائحة الجنة" رواه الطبراني في الأوسط والصغير عن ابن عباس رضي الله عنهما. كشف الخفاء1/435.
4- ولأنه صلي الله عليه وسلم جعل الولد الصالح امتدادا لثواب والديه بقوله: "إذا مات ابن آدم انقطع عمله إلا من ثلاث: صدقة جارية أو علم ينتفع به أو ولد صالح يدعو له".
تنظيم الأسرة:
هو ممارسة تركز على وضع الأسرة ومستقبلها من حيث الإنجاب بحيث تتمكن الأسرة من العيش بصحة وسعادة وفي إطار إمكانياتها ومسؤولياتها.
وهو بشكل عام تعني: أن يقوم الزوجان بتخطيط توقيت إنجاب الأطفال وعددهم، والفترة الزمنية التي تمر بين إنجاب كل طفل وآخر؛ وذلك بغرض تقليل احتمال تعرض الأمهات والأطفال لمخاطر الحمل والولادة في المراحل الخطرة من العمر أو تجنب الحمل غير المرغوب.
أو هو: قيام الزوجين بالتراضي وبدون إكراه باستخدام وسيلة مشروعة ومأمونة لتأجيل الحمل أو تعجليه بما يناسب ظروفهما الصحية والاقتصادية وذلك في نطاق المسؤولية نحو أولادهما وأنفسهما.
أو هو: إيجاد فترات متباعدة بين مرات الحمل، بطريقة مشروعة غير ضارة ، لداع يدعو إلى ذلك.
حكم تنظيم الأسرة:
ربما يتبادر إلى الذهن أن المراد من عملية تنظيم الأسرة، هو: تقليل الذرية في بعض الأزمنة، كما قد يكون تكثيراً للنسل في أزمنة أخرى، فلا شك في أن كثرة النسل أو قِلَّته، ليست وضعاً ثابتاً جامداً، بل يتبدل حسب الظروف والأوضاع، ويتغير تبعاً للأحوال.
وبالتالي فإن تنظيم الأسرة أمر نسبي، لا يخضع لقانون ثابت موحد، بل يرتبط الموضوع ارتباطاً وثيقاً بالمصلحة المرسلة، التي عَدَّها الفقهاء مصدراً من مصادر الفقه الإسلامي.
ويندرج حكم تنظيم الأسرة تحت قاعدة الاجتهاد؛ إذ لا يوجد نص شرعي بخصوصه لفظاً، والاجتهاد - هنا - ينبغي أن يكون مبنياً على جلب المصلحة ودرء المفسدة، دون الخروج على أصول الشريعة، بناء على القواعد المقررة شرعاً من أن: " الضرر يُزال "، " ولا ضرر ولا ضرار "، " والمشقة تجلب التيسير "، قال تعالى: }ما يريد الله ليجعل عليكم في الدين من حرج{[المائدة 6].
والملاحَظ في الشريعة الغراء أن الأمر الذي يتغير بتغير الظروف والأحوال، لا تنص فيه على وضع موحد ونص قاطع، بل تكله إلى اجتهاد البُصرَاء، في ضوء قول الله تعالى: }ولو ردوه إلى الرسول وإلى أولي الأمر منهم لعلمه الذين يستنبطونه منهم{[النساء 83].
