بسم الله الرحمن الرحيم
الحمد لله الذي أنعم علينا بالدين القويم، وخصنا بخير رسله وأنبيائه المبعوث رحمة للعالمين، وقد هدانا ربنا الصراط المستقيم، والصلاة والسلام على من حثنا على فعل الخير ودفعنا للتفقه في الدين، وبعد:
فإن الفقه الإسلامي يُعدَّ من أعظم الثروات العلمية التي تناقلتها الشفاه، وتوارثتها الأجيال، وكتبت فيها الأقلام.
ومن علوم الفقه ما ابتدعه العلماء من نظم القواعد وجمعها والتاليف فيها، وقد أراد الفقهاء من القواعد الفقهية أن يجمعوا شتات مسائل الفقه، وأكدَّوا عليها واعتبروا مَن لا يعتني بها مفرِّطاً في الفقه غير ضابط له.
وتعد القواعد الفقهية ثمرة اختمار الفقه ومسائله في أذهان الفقهاء.
وقد جعل الإمام القرافي القواعد الفقهية موازنة لأصول الفقه، وأنهما معاً يمثلان أصلين كبيرين من أصول الشريعة الإسلامية.
فقال: [هذه القواعد مهمة في الفقه، عظيمة النفع، وبقدر الإحاطة بها يعظم قدر الفقيه، وتتضح له مناهج الفتوى، ومَن أخذا بالفروع الجزئية دون القواعد الكلية تناقضت عليه تلك الفروع واضطربت، واحتاج إلى حفظ جزئيات لا تتناهى، ومَن ضبط الفقه بقواعده استغنى عن حفظ أكثر الجزئيات لاندراجها في الكليات، وتناسب عنده ما تناقض عند غيره] ([1] ) .
فبحور الفقه زاخرة، ورياضه نضرة، ونجومه زاهرة، وأصوله ثابتة ومقررة، وفروعه ثابتة محررة، لا يفنى بكثرة الإنفاق كنـزه، ولا يبلى على طول الزمان عِزُّه.
ولقد قمت بترتيب القواعد الفقهية ليسهل الرجوع إليها من قِبَل إخواني طلبة العلوم الشرعية.
ولسهولة العمل رتبت القواعد ضمن كل فرع أو مطلب أو مبحث ترتيباً هجائياً.
كما أضفت قواعد استنتجتها من خبرة الحياة، ومن صحبة العلماء والحكماء، للجمع بين الفقه ضوابط وقواعد شرعية، وبين الحياة والمعاش تطبيقاً عملياً
والله أسأل أن ينفني بما كتبت، فهو الموفق والهادي إلى سواء السبيل.
